Welcome to Maidvy. These Terms & Conditions (“Terms”) govern your access to and use of the website maidvy.in, the Maidvy mobile application (if any), and all related services (collectively, the “Platform” or “Services”) operated by Logibyte Technologies (“Maidvy”, “Company”, “we”, “us”, or “our”).

By accessing the Platform, making a booking, or engaging our Services in any manner, you (“Customer”, “User”, “you”) agree to be bound by these Terms, along with our Privacy Policy and Refund Policy, which are incorporated herein by reference. If you do not agree with these Terms, please do not use the Platform.

Clause 01

Nature of Services

Maidvy is a household staff placement and facilitation platform. We connect Customers with independent domestic staff, including but not limited to maids, cooks, nannies, babysitters, JAPA (post-natal care) maids, patient caregivers, and all-rounders (“Staff” or “Helper”), across our serviceable locations in Delhi NCR and Bangalore.

Maidvy acts solely as an intermediary/facilitator. We are not the employer of the Staff placed with you, nor are we a placement agency in the traditional sense of controlling the day-to-day work of the Helper. The relationship between the Customer and the Helper is independent, and any employment-like arrangement, wages, working hours, and conduct are to be mutually agreed upon between the Customer and the Helper, subject to the terms of the specific package/subscription chosen.

The service fee charged by Maidvy is strictly for sourcing, verification, coordination, and replacement facilitation, and is separate and distinct from the salary/wages payable to the Helper, which is paid directly by the Customer to the Helper unless otherwise explicitly stated in your subscription plan.

Clause 02

Eligibility and Account Registration

By using the Platform, you confirm that you are at least 18 years of age and competent to enter into a binding contract under the Indian Contract Act, 1872.

You agree to provide accurate, current, and complete information during registration and booking, including your name, address, and contact details, and to keep this information updated.

You are responsible for maintaining the confidentiality of your login credentials (including OTP-based access) and for all activities that occur through your account.

Clause 03

Booking Process

To avail Services, the Customer must submit a booking request specifying the type of Helper required, preferred working hours, location, and duration of engagement.

Upon booking, a Maidvy representative/Relationship Manager (RM) will contact the Customer to confirm requirements and assist in identifying a suitable Helper from our verified network.

While Maidvy will make reasonable efforts to accommodate gender, language, religion, or experience preferences communicated by the Customer, such preferences are subject to availability and cannot be guaranteed.

A booking is confirmed only upon payment of the applicable service fee/subscription amount as displayed on the Platform at the time of booking.

Clause 04

Verification of Staff

Maidvy undertakes a verification process for all Helpers listed on the Platform, which may include identity document checks, address verification, and reference checks, carried out to the best of our operational ability.

While we exercise due diligence in verification, Maidvy does not guarantee the character, conduct, skill level, or continued availability of any Helper, and the Customer is advised to exercise their own reasonable diligence (including in-person interaction/interview) before finalizing an engagement.

Maidvy is not liable for any act, omission, negligence, theft, misconduct, or criminal act committed by a Helper during or after the period of engagement. The Customer’s recourse for such acts shall be against the concerned individual in accordance with applicable law, and Maidvy will extend reasonable cooperation (such as sharing verification records on file) to assist any lawful investigation.

Clause 05

Replacement Policy

Subject to the Customer being on an active, paid subscription/package, Maidvy offers a replacement facility, under which we will make reasonable efforts to provide an alternate Helper if the originally placed Helper is unable to continue, is unsuitable for the assigned tasks, or leaves the engagement, within the validity period of the subscription.

Replacement is subject to availability of Staff in the Customer’s location and category, and the number of replacements permitted (if capped) will be as specified in the chosen package at the time of booking.

Replacement requests must be raised through official Maidvy channels (customer support / WhatsApp / RM) with reasonable detail of the issue faced. Maidvy reserves the right to assess the request before initiating replacement.

The replacement policy does not constitute a guarantee of an immediate replacement; reasonable turnaround time (as communicated by your RM) will apply.
Clause 06

Fees, Payments, and Refunds

All service fees are displayed on the Platform and must be paid in full through the accepted payment methods before a booking is confirmed.

The service fee is non-refundable once a Helper has been successfully placed and the service has commenced, except as expressly set out in our separate Refund Policy.

Refunds, where applicable, will be processed within the timelines specified in our Refund Policy, subject to deduction of any applicable processing/convenience charges.

In case any transaction made towards our Services is questioned, contested, or reversed through a bank or payment gateway, Maidvy reserves the right to respond with relevant records establishing that the Service was duly delivered, including but not limited to booking confirmations, communication records, and Helper deployment details.

Any extension of service duration beyond the originally booked period is subject to availability and will be charged at the applicable extension rate communicated by your RM at the time of request.

Clause 07

Customer Obligations

The Customer agrees to:

  • Treat the Helper with dignity, respect, and in accordance with applicable labour and human rights laws. Any form of harassment, abuse, discrimination, or unlawful conduct towards the Helper is strictly prohibited and may result in immediate termination of service without refund, besides exposing the Customer to independent legal liability under applicable law.
  • Ensure a safe working environment for the Helper.
  • Not sub-let, resell, or commercially exploit the Helper’s services to a third party without Maidvy’s written consent.
  • Make timely salary payments directly to the Helper as mutually agreed, independent of the service fee paid to Maidvy.
  • Report any grievance, safety concern, or dispute involving the Helper to Maidvy customer support promptly, rather than resorting to unilateral or unlawful action.
Clause 08

Cancellation and Termination

The Customer may request cancellation of a booking prior to Helper deployment, subject to the cancellation terms communicated at the time of booking.

Maidvy reserves the right to suspend or terminate access to the Platform or any ongoing service, without prior notice, in case of a breach of these Terms, fraudulent activity, non-payment, or conduct that endangers the safety or dignity of our Staff.

Termination of service by either party does not absolve either party of obligations (including payment obligations) accrued prior to such termination.

Clause 09

Limitation of Liability

To the maximum extent permitted by law, Maidvy’s total liability arising out of or relating to these Terms or the Services shall not exceed the service fee actually paid by the Customer for the specific booking giving rise to the claim.

Maidvy shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of property, loss of data, emotional distress, or any harm arising from the acts/omissions of a Helper, to the extent permissible under applicable law.

Maidvy makes no warranty, express or implied, regarding the continuous, uninterrupted, or error-free availability of the Platform or Staff.

Clause 10

All content on the Platform, including the Maidvy name, logo, design, text, graphics, and software, is the property of Logibyte Technologies and is protected under applicable intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from any part of the Platform without our prior written consent.

Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Platform, you consent to such collection and use.
